Subject access provision

Subject access is a provision under the Data Protection Act 1998, which gives individuals the right of access to personal information held about themselves.

Availability of application forms

Subject access application forms are available from the link on the right hand side of this page, or from main police stations within Staffordshire Police.

Fees

Application for subject access will cost £10. This is a fixed charge per application.

What Information Do You Require?

Section 3 of the form asks for details regarding what information you require.

If you wish to apply for personal information relating to you that may be held on the Police National Computer (PNC), you just need to state that you would like to obtain a copy of your PNC conviction history. This will include details of arrested persons, offenders, suspected offenders, cautioned, reprimanded and warned persons awaiting trial.

If you wish to apply for personal information relating to you, for example, in cases where you have been a victim, a witness, or an offender, to an incident reported to Staffordshire Police, you will need to state what information you require and provide enough details for us to be able to locate this information.

Subject Access

If you are considering making a subject access request, you are reminded of the following:

  1. if an applicant resides outside the force area of Staffordshire Police you should make the request to the force that covers your home address.
  2. as a general rule Staffordshire Police will only accept applications from applicants who have lived in the Staffordshire Police area within the last five years.
  3. the applicant must provide at least two forms of identification, which are sufficient to prove their name, date and place of birth, current address and signature. A personal visit to a police station with the relevant documentation and a £10 fee ensures that the ID documents are returned immediately.
  4. if an applicant lives overseas and wishes their reply to be forwarded directly to a family member in the UK, they must put this request in writing giving clear authority.
Receiving application forms at police stations

Application forms taken to police stations must be accompanied by the identification documents and the £10.00 fee. If sending direct to Headquarters, then copies of the identification documents are acceptable. At the time the form is submitted at the police station, an official receipt will be issued to the applicant.

Headquarters will only issue a receipt and confirmation that the application has been received if a Stamped Addressed Enveloped has been included.
